Ciarán Shiels, solicitor in Madden & Finucane Solicitors said today following the successful appeal against sentence imposed by Mr Justice Weatherup for affray arising out of the disturbances in Coleraine when Mr Kevin McDaid was killed and Mr Damien Fleming was seriously injured.

The Court substituted a sentence of 3 years’ custody and reduced the term of imprisonment to 1 year.

After Court, Mr Shiels said today:

“We welcome this morning’s decision by the Court of Appeal to quash the sentence imposed by the Trial Judge. The Court felt there was merit in our submissions that undue consideration was given to the presence of DNA on a spindle found at the scene and insufficient weight attached to the arrival of the Appellant at Pate’s Lane towards the close of the disturbances. Our client will now be released from custody within a number of days.”
